It happens when someone is treated unfairly compared with others, because of their sexual preference, or their lawful sexual activity. It can also occur because someone makes assumptions about someone else's sexual activity.
Discrimination on Grounds of Sexuality
This is where someone is treated differently because they are, or are perceived to be, homosexual, bisexual, or even heterosexual. This became an issue much more recently, but is covered by law in much the same way. As a result of this it is now against the constituion to be treated unfairly in the workplace.
This would cover direct harassment such as name-calling and inappropriate jokes and bullying, whether it’s intentional or unintentional.
It is against our constitution for any person to carry out a public act that incites hatred or severe ridicule toward a person or group of persons based on their sexuality, transsexuality or HIV/AIDS status.
People discriminate due to the following reasons:
· Lack of awareness and knowledge of discrimination and stigma and their harmful effects
· Lack of understand what HIV/AIDS is
· Fear of becoming infected and not knowing how the infection works
· Linking people with HIV with behavior that is considered improper or immoral
